• WebAIM conducted an accessibility evaluation of the home pages for the top 1,000,000 web sites and found that 96.3% did not meet the Web Content Accessibility Guidelines (WCAG) 2.0 AA standard (Source: www.webaim.org, 2023).
• There were more than 4600 court filings for ADA lawsuits in 2023 (state and federal combined)
• 25% of all lawsuits were against businesses with a previous ADA lawsuit.
  • Often the first lawsuit was for the website and the second for a mobile app.
• 82% of the lawsuits were against eCommerce websites, followed by the Food Service Industry and Education.
• Both large & small businesses were targeted with most targeted businesses having annual revenue under 25 million.
• Desktop Websites were the primary target followed by mobile apps.
